1.: Suitability: The captain must be over 18 years old and is responsible for the equipment entrusted to him. The charter company reserves the right to refuse to hand over a boat to any charterer who he deems unsuitable for operating the boat. In this case, a refund of the amount will be offered without any compensation. 2.: Reservation, Conclusion of Contract, Payment: The booking is confirmed upon signature of the charter contract or when booking online (without signature). Upon receipt of our invoice, a deposit of 40% of the rental price is due within eight days. The remaining amount is due six weeks before the start of the rental without further notice. After receipt of the final payment, the travel documents will be sent to you. If the final payment is not received on time, the charter company is entitled to refuse to hand over the boat to the charterer. For bookings made 6 weeks before departure, the total amount is due immediately. 3.: Deposit: A deposit of €800 and a cleaning deposit of €164, payable in cash or by check, will be required by the charterer on the day of embarkation. This deposit will be refunded upon return, subject to the following proviso: The boat and its equipment must be returned complete and undamaged at the agreed time and place. This deposit corresponds to the insurance deductible and covers the charterer's liability towards third parties for damage caused by the boat, but not by the crew. 4.: Trip Cancellation: a) By the charterer: Cancellation up to six weeks before departure will result in the forfeiture of the deposit. For later cancellations, the entire rental price is due. If the boat is re-rented, only a €100 processing fee will be retained. Travel cancellation insurance is strongly recommended. Rebookings and changes combined with a simultaneous new registration are considered cancellations and are therefore subject to the cancellation conditions. b) By the lessor: If, due to unforeseeable circumstances, the booked boat cannot be delivered, the lessor is obliged to offer the renter a boat of comparable equipment and comfort. If this is not possible, the lessor will immediately refund all amounts paid, without any compensation. 5.: Insurance: The price of the stay includes insurance for the boat and the renter's liability towards third parties in the event of damage caused by the boat. Renters, their personal belongings, and their own civil liability are not covered. Bicycles are your responsibility, and in the event of loss or theft, they will be charged to you. 6.: Accident: The renter is obliged to contact the lessor immediately by phone in the event of damage or an accident. In the event of an accident involving third parties, the renter must neither admit guilt nor have the boat repaired without the consent of the lessor. If the renter has an accident and is therefore unable to continue their trip, they cannot claim compensation. 7.: Embarkation. Embarkation takes place on the agreed date, after all formalities have been completed, the boat and cleaning deposits have been paid, and the condition of the boat and equipment has been checked against the inventory list. The renter may take over the boat after a theoretical and practical briefing. If they do not have an inland waterway license, a temporary charter certificate will be issued for the duration of the rental period after a detailed theoretical and practical briefing. The renter may refuse to take over the boat if its equipment does not comply with the contract or if it is not handed over to the renter in a proper, clean, and fully equipped condition. The charterer reserves the right to change the departure location if embarkation is not possible due to force majeure or unforeseeable circumstances at the booked base. 8.: One-Way Trips - Round Trips: The pick-up or drop-off location can be changed without giving reasons. 9.: Disembarkation: The boat and its equipment must be returned to the destination port, date, and time specified in the contract, and in an undamaged and clean condition, unless the charterer is delayed during the trip due to unforeseeable circumstances (e.g., a broken lock). The charterer should allow a certain amount of time to avoid delays. The charterer reserves the right to demand compensation from the charterer if the charterer does not return the boat on time or leaves the boat at a location other than the base. 10.: Use of the Vessel by the Charterer: The charterer must comply with the rules of river navigation and follow the instructions provided by the charterer and the river authorities. The renter agrees not to drive the boat after dark and not to lend it to third parties. They also agree not to bring on board any crew members who were not registered at the time of embarkation. 11.: Inaccessibility of the Waterway: If, due to unforeseeable events, a waterway is no longer navigable or the journey is difficult, the location and date of departure may be postponed. If these events make the cruise impossible, the rental price can be used as a voucher for another cruise, subject to boat availability. These provisions also apply during the cruise if, for the same reasons, the cruise must be interrupted for more than 48 hours. 12.: Breakdowns: Breakdown service is included in the rental price. The lessor will endeavor to repair the breakdown properly as soon as possible. a) Breakdowns not attributable to the renter: If the boat is out of service for more than 24 hours due to a breakdown and no replacement boat can be provided, the lessor agrees to compensate the renter pro rata for the time lost. The duration of the outage is calculated from the time the renter notifies the owner of the breakdown. Under no circumstances may the renter attempt to repair the boat themselves. b) Breakdowns attributable to the renter: If it is determined that the breakdown was caused by the renter, the renter is not entitled to compensation for the downtime. The owner may retain the deposit in proportion to the cost of the repair. c) Bow thruster: If the bow thruster fails, there is no compensation; the technician will not carry out repairs in such cases. If the renter nevertheless requests repairs, the kilometers driven for the outward and return journey will be charged at 33 cents per km. d) Toilet blockage: In the event of a toilet blockage, a compensation of €100.00 and a fee of 33 cents per km driven for the outward and return journey will be charged. 13.: Boat Equipment - Personal Belongings: The renter must notify the owner of any loss, damage, or theft of any inventory accessories and is obligated to reimburse them. The landlord is not responsible for loss or damage to the tenant's personal belongings. 14.: Place of jurisdiction: Neuruppin. As of February 1, 2011
